Our Obligations To You

Assessment Of Unsuitability For A Credit Contract - Our Obligations And Your Rights

Before we can provide credit to you, we are required to make an assessment as to whether the proposed credit contract is 'not unsuitable' for you. To do this we must make reasonable inquiries about:

  • Your requirements and objectives in relation to the credit;
  • Your financial situation; and
  • Any other relevant matters.

The NCCP Act prohibits us from entering into a loan contract with you if the contract is unsuitable for you. A loan contract is deemed to be unsuitable for you if, at the time you enter it:

  • It was likely that you would be unable to comply with the financial obligations under the contract, or could only comply with substantial hardship; or
  • the contract did not meet your requirements or objectives; or
  • It was presumed to be unsuitable because the loan contract was for a small amount credit contract (as defined under the NCCP Act); and
  • You were in default under another small amount credit contract; or
  • In the 90 days before, you owed money under 2 or more small amount credit contracts, and we cannot prove that you can comply with your credit contract obligations without substantial hardship.

To determine if a loan contract will be unsuitable, we only take into account information about your financial situation, requirements or objectives that, at the time of entering into the contract, we had reason to believe true. We must also take reasonable steps to verify your financial situation. This will require you to provide certain documents to us and therefore it is very important that the information you provide to us is accurate and correct.

Requesting A Copy Of Our Loan Suitability Assessment

Pursuant to the NCCP Act, we are obliged to assess your credit application to ensure that a loan is not unsuitable for you. This is the Loan Suitability Assessment.
Before entering into a credit contract, or at any time within 7 years of the date of the credit contract, you can request a written copy of our Loan Suitability Assessment. There is no fee for requesting a copy of our Loan Suitability Assessment.
If you ask to see our Loan Suitability Assessment within the first 2 years of the credit contract, we will provide you with a written copy of our assessment within 7 business days after we receive your request. Otherwise, we will provide you with a written copy of our Loan Suitability Assessment within 21 business days after we receive your request.
